Hi Steve,
The bank does not have to foreclose and under the CA non-judicial foreclosure timeline they can postpone a sale for up to one year (postponing it each month without having to refile a new notice) before they have to cancel that Notice of Trustee Sale and file a new one. The Notice of Sale expires after one year.
