When can I legally give the 3 day notice

The occupants are the ex-owner, not the renter.

When can I legally give the 3 day notice for the eviction process? After the deed is recorded ( noramml about 10 day after the trustee sale) or on the day (or a day after) the trustee sale is completed?

So far, we have been waiting util the deed is recorded, but that seemed to give the ex-owner false impression that we are flexible on time. It also drag the process too long. Please advice.
