House selling

I own my house and its still in my maiden name, I am now married but never added my husband or change the title to my married name. Rather than re-financing at 80 loan to value can i sell my husband my house legally?

As long as the lender who holds the current note is paid in full you can sell it to whom ever you choose. If it is a short sale you cannot sell it to a relative.

Why not just add him to the title and update your vesting including your name and the way you want to hold title then. You can also set up an A-B trust to manage the asset and prevent it from going to probate. Also, if the property is in CA, and you have been married for more than 4 years, the assets you have are considered joint assets.

It might be wise to talk to a Estate attorney to help guide you on what you are trying to accomplish.
