Renting property that's gone into foreclosure. What are my rights?
We rented a house in june 2009, however owners did not wanted to provide a rental agreement at that time, its now august and owner was forced to provide a month to month rental agreement stating that my move in date started in june, 09, but the lease agreement was signed and dated 08/10/09....
Landlord has refused to give us a key to the mail box, therefore they pick up the mail at there convinience and drop off to us, in ocasions my peronal mail is delivered opened and my utilities are already on past due notices and sometimes its a closing bill, causing us to run everytime at the last minute so they don't disconnect our utilities, I have asked to be provided with a key and she refuses to do so! reason being i just found out she has not made a mortgage payment on this house for at least 8 to 10 months. but she still is expecting us to pay rent or else she wants to evict us, when in fact we have a rental agreement.
PLEASE ADVISE WHAT RIGHTS DO WE HAVE AS TENANTS: ? Do we continue to pay rent to her in order to avoid being evicted or do we wait for the bank to evict us, since she is not willing to refund us our money or help us relocate? PLEASE ADVISE YOUR, ADVISE WILL BE GLADLY APPRECIATED.

First of all, your landlady doesn't deserve full rent unless she provides you with a key to the mailbox and normal mail delivery. In my opinion, she should have USPS forward her mail to a different address. Other than that, until a trustee sale occurs, the landlady is still the owner, and thus, you are obligated to continue paying rent to her. If, and when, a trustee sale does occur, you will then become obligated to pay rent to the new owner. Good luck!
First, it is a Federal offense to open mail addressed to someone else. Tom is right that you still owe rent even if the property is in foreclosure. I would highly suggest getting a post office box and having all of you mail sent to the PO Box. As simple change of address with the post office will take care of that problem.
