Signed into a pre-mod. agreement which cured all arrearages in addition to a escrow deficiency of $5016.73. In the middle of pre-mod. our mtg. was sold. We receive final mod docs. following all required payments. Our New UPB is exactly the same. We are informed that following our 2010-2011 tax payment, the new servicer will terminate our escrow acct; which we're OK with.

My house is up for auction and I haven't paid property tax or HOA dues since January 2011. Will those costs need to be absorbed by the bank if my home becomes bank owned?
Will a BK enable me to stay in my home longer at this point?

My house originally was foreclosed on last year (Oct 2010). Since, I had tenants at my home and the proper lease agreement, the bank was unable to evict me or my tenants till the the lease term was over, which was the following August 2011. When August came around, I instead received a new Notice of Trustee Sale. I was in shock because I thought my house had sold. Anyway, I went through my past correspondence from the bank and realized that I had overlooked an important document. Apparently the bank had rescinded the sale.
